Regarding: Response to Defamation of Conceptual Options

Dear, T.C. Johnston,

I understand Conceptual Options concern and desire of removing any history of Theresa Erickson from their name in the Surrogacy community. That was evident as soon as she plead guilty to what the media has labeled as baby selling and the Conceptual Options website was wiped clean of her name, videos, and background.

It is also understandable that Theresa Erickson would transfer her 100% ownership stake in Conceptual Options in an effort to protect the financial interest of the company from liability since part of the federal sentencing includes restitution to the victims which while already agreed to be over $100,000 may extend to the over $600,000 that Sharp hospital has requested from the courts and this doesn't include the damages from potential Civil lawsuits.

My understanding is that you are making the claim that Theresa Erickson is not the owner of Conceptual Options and that the Conceptual Options principals had no knowledge of her actions.



In response to this statement, I would like to present the Conceptual Options Buyout Agreement which clearly states that Theresa Erickson was a 50% owner of Conceptual Options from September 30th, 2002 to July 14th, 2008. Then on July 14th, 2008 she became the 100% owner of Conceptual Options.

According to the federal allegations against Theresa Erickson the Conspiracy began no later than 2005. At the time of her crimes Theresa Erickson was the owner of Conceptual Options.

In regards to your following request:

"In that light, we ask that you remove the above posts to the extent they reference Conceptual Options as related to the activities of Ms. Erickson. We also ask that the edited/removed posts be replaced/appended with a retraction that clearly states that Theresa Erickson is not the owner of Conceptual Options, LLC, and that her acts were not under authority or with the knowledge of Conceptual Options."

Conceptual Options has always been a family run business that Theresa Erickson founded and owned from the beginning. The main staff have all been family including her husband John Erickson, sister Mary Ann Lathus, brother George Sims, sister in law Jennifer Sims, mother Loren Glaser, son Elijah Erickson, and daughter Megan Erickson.

As the owner of Conceptual Options at the time of her crimes Theresa was the only principal owner and would not require the knowledge or consent of anyone else involved with the organization. Plus, I would expect her family to make the statement that they had no knowledge of the activities in their attempt to keep Conceptual Options open.

I would consider updating and posting the current ownership information for Conceptual Options if you can provide the sales agreement or transfer of ownership paperwork that has taken place after July 14th, 2008.
